Rental Terms and Conditions

This is a courtesy translation. In case of any discrepancy, the Spanish version prevails.

These terms govern the rental of motorcycles and related services offered by Yandy Ventures (hereinafter “SKAPA”, “we” or the “Provider”) under the SKAPA Adventure brand, operating in Chihuahua, Mexico. By booking, paying for, receiving or using a SKAPA motorcycle, you (the “Customer” or “Renter”) accept these terms.

1. Purpose of the service

SKAPA rents Royal Enfield Himalayan 450 motorcycles and may offer optional services such as route and hotel recommendations, delivery/pickup logistics near the Chihuahua airport and pre-trip guidance. The exact scope of each booking is defined in the confirmation sent via WhatsApp, email or the official booking channel.

2. Renter requirements

  • Be of legal age under applicable Mexican law.
  • Present a valid official ID (INE/passport) and a valid driver's license authorizing motorcycle operation.
  • Have sufficient experience to ride an adventure motorcycle on pavement and, where applicable, on dirt roads.
  • Truthfully state country of origin, contact details and offroad experience level when requested.

SKAPA may refuse or cancel delivery if it detects incomplete, altered or expired documentation, or if it considers that there is a reasonable risk to the safety of the Customer, third parties or the unit.

3. Booking, prices and payments

Rates published on the website or communicated through official channels may be updated without prior notice until the booking is confirmed. Prices may vary depending on duration, season and additional services. Payment is the full rental amount at the time of booking. Unless otherwise agreed in writing, payments are made in Mexican pesos (MXN) through the methods indicated by SKAPA.

Applicable taxes (including VAT/IVA where applicable) will be itemized in accordance with the invoice or receipt issued. Coupons or discounts only apply if expressly confirmed by SKAPA.

4. Delivery and return

Unless otherwise agreed, delivery and return take place at SKAPA's operating point in Chihuahua (hangar / location near the airport). The Customer must show up on the confirmed date and time. Delays by the Customer may reduce the rental time with no right to a proportional refund, unless due to a cause attributable to SKAPA.

At delivery, the condition of the motorcycle will be documented (inventory, odometer, fuel, accessories and visible damage). The Customer must report any anomaly before leaving. On return, a comparable inspection will be carried out; missing items, unreported damage or incomplete fuel may result in additional charges.

5. Permitted use and prohibitions

The Customer agrees to:

  • Use the motorcycle diligently, in accordance with the manual and Mexican traffic laws.
  • Wear a helmet and appropriate protective gear; their correct use is the Customer's responsibility.
  • Not assign, sublease or allow unauthorized third parties to ride the unit.
  • Not take part in competitions, stunts, towing, illegal commercial transport or unlawful activities.
  • Not ride under the influence of alcohol, drugs or medications that impair riding.
  • Respect load limits, including the side and rear cases supplied.
  • Not cross international borders or leave the authorized territory without SKAPA's written permission.

6. Mileage, routes and dirt roads

Unless the booking confirmation states otherwise, the rental covers use on paved and dirt roads typical of the Sierra Tarahumara / Barrancas del Cobre (Copper Canyon). The Customer assumes the risk inherent to offroad riding: falls, flat tires, loss of control, weather conditions and deteriorated roads. SKAPA may recommend routes, but the decision to take them and the riding pace are the Customer's.

7. Insurance, deposit and liability

The rental may include insurance coverage in accordance with the policy in force at the time of booking. The exact scope (third-party damage, theft, deductible, exclusions) is communicated at the Customer's request (“Ask for details”). Excluded, including but not limited to, are damages caused by willful misconduct, gross negligence, riding under the influence of substances, unauthorized use, loss of keys, uninsured accessories or traffic violations.

SKAPA may hold a security deposit (cash, card or other means). The deposit is released after the return inspection, less any legitimate charges. The Customer is liable for fines, tolls, traffic violations and proceedings arising from the use of the motorcycle during the rental period.

8. GPS and telemetry

Units may be equipped with GPS devices or other location systems for safety, theft recovery, operational support and contractual compliance purposes. The Customer authorizes such monitoring during the rental term, in accordance with the Privacy Notice.

9. Cancellations and no-shows

If the Customer cancels at least ten (10) calendar days before the rental start date, SKAPA refunds 100% of the amount paid. Cancellations made less than ten days in advance, failing to show up on the delivery date, or failing to meet documentation requirements do not entitle the Customer to a refund, unless otherwise agreed in writing. SKAPA will refund or reschedule when the cancellation is attributable to its own operational failure, subject to availability.

10. Independent guides and third parties

When SKAPA shares the contact details of local riders, hotels, restaurants or small-plane services, it does so as a recommendation. Unless the service is expressly included and charged by SKAPA, those third parties are independent; hiring, payment and the legal relationship are entered into directly between the Customer and the third party. SKAPA is not liable for acts or omissions of independent third parties.

11. Limitation of liability

To the extent permitted by Mexican law, SKAPA is not liable for indirect damages, lost profits, loss of opportunity or personal travel expenses (flights, hotels, etc.), except in cases of proven willful misconduct or gross negligence. SKAPA's maximum liability, where applicable, is limited to the amount actually paid by the Customer for the corresponding rental.

Motorcycling involves risks. The Customer declares to be aware of them and rides under their own responsibility, without prejudice to SKAPA's legal obligations as a service provider.

12. Personal data

The processing of personal data (including data collected via WhatsApp, forms, GPS and bookings) is governed by the Privacy Notice available on this website, under the terms of the Mexican Federal Law on the Protection of Personal Data Held by Private Parties and its Regulations.

13. Governing law and jurisdiction

These terms are interpreted in accordance with the laws of the United Mexican States. For any dispute, the parties submit to the competent courts of Chihuahua, Chihuahua, waiving any other jurisdiction that may correspond to them by reason of their present or future domicile.
