Privacy Notice

In compliance with the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, “LFPDPPP”), its Regulations and the Privacy Notice Guidelines issued by the competent authority, Yandy Ventures (“SKAPA”, “we” or the “Data Controller”), which is responsible for processing your personal data under the SKAPA Adventure brand, makes this Notice available to you.
1. Identity and address of the Data Controller

2. Personal data we collect
We may collect, including but not limited to:
- Identification and contact: name, phone number, email, country of origin, social media or WhatsApp.
- Rental documentation: INE (Mexican official ID)/passport, driver's license, its validity and type.
- Booking data: arrival/departure dates, rental mode, route preferences, offroad experience.
- Billing and payment data where applicable (RFC tax ID, tax address, receipts).
- Location data derived from GPS or other devices installed on the motorcycles.
- Communications: WhatsApp messages, web forms, emails and customer service notes.
- Technical website browsing data (cookies, IP, device) to the extent they are enabled.
We do not intentionally collect sensitive data unless it is strictly necessary and with the consent required by law.
3. Purposes of processing
Primary (necessary for the service): managing bookings and motorcycle rentals; verifying identity and documentation eligibility; delivering and recovering units; providing support during the trip; managing payments, deposits and invoicing; locating the motorcycle in case of theft, loss, emergency or breach of contract; handling incidents; complying with legal obligations.
Secondary (optional): sending SKAPA marketing information, news about locations or routes, satisfaction surveys and promotional content. You may object to secondary purposes by sending an email to the contact address in this notice.
4. GPS and geolocation
The motorcycles may be equipped with GPS or other tracking systems. Geolocation is used for the safety of the Customer and the unit, theft recovery, operational assistance, verification of use in accordance with the rental agreement, and fraud prevention. Processing is limited to the rental period and the retention periods indicated, unless required by an authority.
5. WhatsApp and messaging channels
If you initiate or accept communication via WhatsApp or another messenger, we will process the content necessary to handle your request (bookings, questions, hotel/route recommendations, follow-up). These channels may be operated with business tools; we recommend that you do not send excessive data or sensitive documents via chat when a more secure alternative exists.
6. Transfers
We may share data with: payment and invoicing providers; insurers and adjusters in the event of a claim; cloud computing / hosting services; legal or accounting advisors; competent authorities when there is a duly grounded order. We do not sell personal databases.
When we share the contact details of guides, hotels or other independent third parties so that you can hire them directly, you decide what data you give them; that processing is the responsibility of the third party.
7. Retention
We will retain data for as long as necessary for the purposes described, for tax and contractual obligations, and for the exercise or defense of legal claims. GPS records are kept for the reasonable operational period and the applicable legal period; afterwards they are deleted or anonymized.
8. ARCO rights and revocation of consent
You may exercise your rights of Access, Rectification, Cancellation and Opposition (ARCO), as well as limit the use or disclosure of your data and revoke your consent, by sending a request to hola@skapadventure.com, stating your full name, a contact method, a clear description of the request and a document proving your identity. We will respond within the time limits set forth in the LFPDPPP.
9. Security measures
We implement reasonable administrative, technical and physical measures to protect data against damage, loss, alteration, destruction or unauthorized use. No system is infallible; if you detect an incident involving your data, please report it to the privacy email address.
10. Cookies, analytics and advertising
The website uses cookies, pixels and similar technologies for basic operation, to understand how it is used and to measure our advertising campaigns. When enabled, we use the following third-party tools:
- Google Analytics (Google LLC): visit and website usage statistics.
- Google Ads (Google LLC): ad conversion measurement and advertising audiences.
- Meta Pixel (Meta Platforms, Inc.): ad measurement on Facebook and Instagram.
- TikTok Pixel (TikTok): ad measurement on TikTok.
- Microsoft Clarity (Microsoft Corporation): heatmaps and anonymous session recordings.
These tools may record pages visited, where your visit came from (for example, the ad or website that sent you), device and browser type, approximate location derived from your IP address, clicks, scrolling and booking steps completed. We do not send them your name, email or phone number, and we do not use them to identify you by name. We also store the origin of your visit (source, campaign and landing page) with your lead so we know which channels work for us.
You can reject or delete cookies in your browser settings, use private browsing or tracking blockers, and install the Google Analytics opt-out add-on. You can adjust personalized advertising in Google Ad Settings, Meta Ad Preferences and the ad settings in your TikTok account. See also the Microsoft Privacy Statement. If you block these technologies, the website will keep working.
11. Changes to this notice
SKAPA may modify this notice. The current version will be published on this website with the date of the update. Continued use of the services after a material change implies awareness of the updated notice, without prejudice to any consents required by law.
12. Consent
By providing your data, booking, using the website, communicating via WhatsApp or accepting a motorcycle with GPS, you acknowledge that you have read this Privacy Notice and, where required by law, you give your consent to the processing for the purposes described herein.
